Chicago Motor Cars 2012 Lamborghini Adventador ZHWUC1ZD8CLA00104
2012 Lamborghini AdventadorChicago Motor Cars 2012 Lamborghini Adventador ZHWUC1ZD8CLA00104

The following is a version of a letter that has been sent out to many dealerships throughout the United States outlining the story of a 2012 Lamborghini Adventador that ended up in the hands of Chicago Motor Cars.   This car has quite a history, but it seems as though the seller, Chicago Motor Cars, is failing to report the car's actually history.  Being a strong advocate for consumer's rights, I believe it is a dealer's responsibility to know the history of the cars they are selling.  Chicago Motor Cars has a reputation for withholding that information and at times exaggerating the truth.  Because a Lamborghini is a high priced vehicle and the one featured in this story looks fantastic, I can't help but feel it is my responsibility to protect a future purchaser whether it be a private consumer or another dealer.

This 2012, white Lamborghini Adventador was originally a special order for singer/artist Missy Elliot.  Another Chicago dealer failed to follow through on that order and the car ended up in Houston, TX.  That dealer is currently no longer in business because of this lawsuit.  The driver in Houston did not know how to properly handle a car with this much power and subsequently got into an accident hitting 6 people and other cars in a parking lot outside a bar.  There are multiple recordings from patrons and a local news station did a story on the accident.  We have obtained the police report and the VIN matches the car that ultimately ended up back in Chicago at Chicago Motor Cars.  Somehow, within a month, the Lamborghini was repaired, yet the CarFax still maintained that the car had a  clean record and has never been titled, "be the first owner."  I strongly believe Chicago Motor Cars was fully aware of the actual history of this car before going on to selling it to a Ohio dealer.  When the dealer in Ohio questioned a mark on the front bumper, Chicago Motor Cars blew them off stating it was a minor scratch that their service department repainted.  Believing Parin Shah's word, the Ohio dealer purchased the Lamborghini and ultimately sold it to one of their regular customers.  We notified the Ohio dealer that the car they had purchased was indeed involved in an accident that was not disclosed and sent them all the proof.  That dealer was then put in the position to contact the buyer to get the car back and through communications with Chicago Motor Cars, got them to buy the car back.

Chicago Motor Cars again has possession of this car.  This car is not worth the $420,000 price tag they originally had on the car!  This car has had extensive damage and repair.  Please keep your eyes open and be on alert for what will sound like a too good to be true deal on a 2012 white Lamborghini.  It will be too good to be true.   Chicago Motor Cars needs to be held responsible for not being honest with their customers and if they have to eat the cost of this car, so be it.  We will continue to monitor this car as close as we can to assure that wherever this car goes, the owner knows the ACTUAL history of their car.

Thank you for your time. If you would like any additional information, please feel free to contact me.  The VIN to watch for is:  ZHWUC1ZD8CLA00104

____________________________________________________________________________________________________________________________________________________________________________________________________________

Chicago Motor Cars somehow became aware that this letter was sent out.  That evening, my parents received a death threat from "someone" in Chicago.  They told my parents I was messing with the wrong people in Chicago, and if they couldn't get to me, they would kill my parents and family.  Fortunately, I come from a very strong and confident background and my mother just laughed at them; slightly risky, but I'm glad she did that.  They have not heard from them since.

Also, since sending the letter, we were contacted again by the Ohio dealership mentioned in the letter.  They thanked us for passing along the actual facts of the vehicle they sold and informed us that Chicago Motor Cars was forced to buy the car back.  We then contacted Frank Sacco, told him we knew he was in possesion of the car again and offered to buy, strictly for investigation purposes.  Within 2 weeks, Frank once again sold that car to another dealer, and once again, Frank witheld the true facts of the car.  He told his new buyer that the car had a minor scratch from a speed bump, so there was some minor repainting done.

Luckily, the dealer that was fraudulently convinced to purchase the car has reached out to us. I will forward you that email separately as proof that dealerships are reaching out to us and it's not always us reaching out to them.  I spoke to that gentleman last evening and to say he was upset at Parin Shah and Chicago Motor Cars is an understatement.  He too will be contacting one of his top customers that purchased the car to inform him of the car's true value.  And once again, another dealer will hopefully be forcing Chicago Motor Cars to buy the vehicle back.

These dealers that Frank Sacco and Parin Shah are fraudulently convincing to purchase these cars are high end, reputable dealers.  The last thing they want is a negative association with a fraudulent dealership.  As expected, they would like to preserve their reputation in the industry.

So, despite what you may have heard, I am not some internet vigilante.  We just want to expose a very crooked, unethical dealership and help anyone else Chicago Motor Cars is looking to take advantage of.  And I do believe because of us, many people have been helped.  Just with this Lamborghini alone, we have helped 4 different customers.  We will continue to follow Chicago Motor Cars for as long as they are in the business of selling cars.  Once you have had the experience we have had, you want to do what you can to prevent more fraud cases and advocate for the others that won't or can't advocate for themselves.

Thank you again for your time.  I look forward to seeing the story air.  All of your hard work has been very much appreciated.

Sincerely,

David Bates

Here is the sales ad on Chicago Motor Cars website 05/17/2013
You will notice the ad shows some fraudulent statements
1. VIRTUALLY BRAND NEW! A car that has been involved in a serious accident should NEVER be listed as "virtually brand new."  The car had significant repairs.
2. VEHICLE HISTORY:
Only 1,877 Miles!
Never Titled! Be The First Owner!  If the car was not titled, then it was being driven illegally, because the car DID have a previous owner in Houston.
Absolutely Brand-New Condition Throughout!  The only brand new thing on this car is the front end that was repaired after the accident.
Spotless Vehicle History Reports A spotless vehicle history does not mean the car is clean, it simply means nothing was reported to CarFax.  This car DOES have history.
-AutoCheck Guaranteed-
-CARFAX Guaranteed-
-No Previously Reported Accident History- Failure to report an accident does not mean an accident did not occur, it simply means nobody properly reported it.

And here is the listing Chicago Motor Cars changed the listing to once they were notified we were investigating:
1. VIN #: ZZZZZZZZZZZZZZZZZ  The only reason we feel Chicago Motor Cars would have changed the VIN to all Zs is to make it harder to track or to hide the actual history.
2. The entire VEHICLE HISTORY section is missing.  By deleting the entire vehicle history, we think Chicago Motor Cars is attempting to delete fraudulent statements that would surface in a court.

Here are pictures of the car after it was involved in the accident.  As you can see, it would appear that the accident was severe enough to cause airbag deployment.

On April 29, 2013, Chicago Motor Cars posted this picture on their Facebook page as if they are actually documenting getting rid of a car they knew was damaged, yet receiving full payment for.  Little did they know David Bates was still watching them and will always be watching them.  Parin Shah and Frank Sacco have taken advantage of too many people and unfortunately still are.

The following is a link to the sales page Marshall Goldman, of Ohio, used to sell the car based on the information given to them by Parin Shah.  Keep in mind, this dealer did notice new paint on the front end of the car, but was told it was simply repainted due to a minor scratch.

This link will show you the advertisement shown by Ferrari Maserati in Fort Lauderdale, FL.  By this time, there are no excuses for Chicago Motor Cars.  They were legally obligated to disclose all the facts related to this car, but chose to lie again.  This time, they told their buyer, who again noticed new front end paint, that the previous driver went over a speed bump too quickly causing some minor damage that simply required some new paint.

Based on the information reported to CARFAX, this vehicle is worth $0 more than the retail book value.

This CARFAX Vehicle History Report is based only on information supplied to CARFAX and available as of 7/5/13 at 11:21:14 AM (EDT). Other information about this vehicle, including problems, may not have been reported to CARFAX. Use this report as one important tool, along with a vehicle inspection and test drive, to make a better decision about your next used car.
Rebuilt/Reconstructed Title
A Rebuilt/Reconstructed vehicle is a salvage vehicle that has been repaired and restored to operation. These vehicles are often severely damaged before they are rebuilt and refurbished parts are typically used during reconstruction. In most states, an inspection of the vehicle is required before the vehicle is allowed to return to the road.
Manufacturer Buyback or Lemon Title
A DMV or a state agency marks an official document or issues a Manufacturer Buyback/Lemon title when a vehicle has been repurchased by the manufacturer. Not all states issue manufacturer buyback titles and the specific requirements for a lemon law vehicle varies by state.
Odometer Check
CARFAX analyzes mileage data to help identify potential:
  • Rollbacks - odometer tampering to conceal a car's true mileage (i.e. Fraud or illegal activity)
  • Rollovers - after reaching the maximum reading, the odometer restarts from zero (i.e. Mechanical or equipment limitation)
  • Inconsistencies - conflicting mileage data means CARFAX cannot determine if it's a potential rollback (i.e. Potential human error)
Manufacturer Recall
Automobile manufacturers issue recall notices to inform owners of car defects that have come to the manufacturer's attention. Recalls also suggest improvements that can be made to improve the safety of a particular vehicle. Most manufacturer recalls can be repaired at no cost to you.
Basic Warranty
Most manufacturers offer a basic warranty for new vehicles. These warranties vary by manufacturer and typically last for a certain amount of time and/or a set number of miles.
Not Actual Mileage Title
When the seller certifies, under the Federal Odometer Act, that the odometer reading does not reflect the vehicle's actual mileage. This may occur because the odometer was tampered with, broken, or replaced.
Junk Title
A Junk Title is issued on a vehicle damaged to the extent that the cost of repairing the vehicle exceeds approximately 75% of its pre-damage value. This damage threshold may vary by state. The majority of states use this title to indicate that a vehicle is not road worthy and cannot be titled again. Some states treat Junk titles the same as Salvage.
Loss Due To Fire Title
The vehicle sustained major damage due to fire. In most states, fire damage titles are issued when the cost of repairing the vehicle for safe operation exceeds its fair market value.
Exceeds Mechanical Limits Title
A vehicle with a 5-digit odometer cannot accurately track mileage after 99,999 miles because the odometer rolls over. This title is the result of a seller certifying under the Federal Odometer Act, that the odometer reading EXCEEDS MECHANICAL LIMITS of the odometer.
Structural Damage
All levels of accidents, from minor to severe, can cause structural damage to a vehicle (i.e., damage to the frame or unibody).
Airbag Deployment
Occurs when the driver, passenger or side airbag has been used or deployed during a crash or other incident. If an airbag has been deployed, it must be replaced by a qualified technician. Have this car inspected by a mechanic prior to purchase.
Salvage Title
A Salvage Title is issued on a vehicle damaged to the extent that the cost of repairing the vehicle exceeds approximately 75% of its pre-damage value. This damage threshold may vary by state. Some states treat Junk titles the same as Salvage but the majority use this title to indicate that a vehicle is not road worthy and cannot be titled again in that state. The following eleven States also use Salvage titles to identify stolen vehicles - AZ, FL, GA, IL, MD, MN, NJ, NM, NY, OK and OR.
Total Loss
An insurance or fleet company declares a vehicle a total loss when a claim exceeds approximately 75% of its pre-damage value or if the vehicle is stolen and not recovered. This damage threshold varies by company. These companies typically take possession and obtain the title. Not all total loss vehicles result in a DMV-reported branded title, like a Salvage or Junk title. See the glossary for more information.
Accident / Damage Indicator
Various events could indicate an accident or damage in a vehicle's history, such as: salvage auction, fire damage, police-reported accident, crash test vehicle, damage disclosure, collision repair facility and automotive recycler records. See the glossary for more information.
Hail Damage Title
The vehicle sustained major damage due to hail. In most states, hail damage titles are issued when the cost of repairing the vehicle for safe operation exceeds its fair market value.
Flood Damage Title
States issue flood titles when a vehicle has been in a flood or has received extensive water damage.

Glossary

First Owner
When the first owner(s) obtains a title from a Department of Motor Vehicles as proof of ownership.
Fleet Vehicle
Vehicle was registered or sold to a company that manages vehicle fleets.
Ownership History
CARFAX defines an owner as an individual or business that possesses and uses a vehicle. Not all title transactions represent changes in ownership. To provide estimated number of owners, CARFAX proprietary technology analyzes all the events in a vehicle history. Estimated ownership is available for vehicles manufactured after 1994 and titled solely in the US including Puerto Rico. Dealers sometimes opt to take ownership of a vehicle and are required to in the following states: Maine, Massachusetts, New Jersey, Ohio, Oklahoma, Pennsylvania and South Dakota. Please consider this as you review a vehicle's estimated ownership history.
Title Issued
A state issues a title to provide a vehicle owner with proof of ownership. Each title has a unique number. Each title or registration record on a CARFAX report does not necessarily indicate a change in ownership. In Canada, a registration and bill of sale are used as proof of ownership.
CARFAX DEPENDS ON ITS SOURCES FOR THE ACCURACY AND RELIABILITY OF ITS INFORMATION. THEREFORE, NO RESPONSIBILITY IS ASSUMED BY CARFAX OR ITS AGENTS FOR ERRORS OR OMISSIONS IN THIS REPORT.
